This Shipping & Delivery Policy is part of our Terms and Conditions (“Terms”) and should be therefore read alongside our main Terms: https://chateaucellars.com/terms-conditions/.

Please carefully review our Shipping & Delivery Policy when purchasing our products. This policy will apply to any order you place with us.

WHAT ARE MY SHIPPING & DELIVERY OPTIONS?

In-Store Pickup

In-store pickup is available for all purchases. Pickups are available Monday – Saturday from 10 AM – 6 PM. All orders for in-stock wines may be scheduled for local pick-up from our Ybor / South Tampa location or our Carrollwood / North Tampa location. You can schedule your pick-up appointment by sending an email to [email protected] or using our contact form. Same day and “drop-in” pick-up is not available. Visit our Contact Us page for current Customer Pick-Up hours and location. When your order has been packed and moved to our Pick-Up Office, you will be notified by email. If you have not received this email by your scheduled pick-up date, please contact us. If someone else will be picking up your order, you must inform us in advance who will be coming to pick-up your wines. You, or your designated alternate, must be 21+ years old and provide a valid government-issued ID with date of birth. Chateau Cellars will hold your items for 30 days once your order is ready for pick up. If your order has not been picked up within that time frame, your order will be moved to storage. A restocking fee of $2 per bottle ($10 minimum) will apply. Storage fees may also apply. In no event will orders be held in a Pick up Area for more than 30 days. Chateau Cellars reserves the right to limit the days of the year that this service is offered. The option at checkout to Add to Storage is for current storage clients only and will only be available if the client has extra storage. Otherwise the customer must pick up wine or pay for shipping. The option at checkout to Hold wine is for potential new storage clients. A Chateau Cellars employee will be in contact to discuss storage costs. If no storage is available or the customer does not wish to pay for storage, the customer must pick up wine or pay for shipping.

Standard and Expedited Shipping Fees

Orders are typically prepared for shipping within 3 working days.  Orders are shipped by using common carriers.

Flat Rate, Expedited, and Ground shipping options available.  Shipping fees are determined by bottle sizes and weights.

If you select an expedited shipping option, we will follow up after you have placed the order with any additional shipping information.

All times and dates given for delivery of the products are given in good faith but are estimates only.

In the United States, alcohol shipping laws continually change. If at the time of delivery, we are unable to legally deliver wine to you, we will cancel your order and refund 100% of your payment if an alternative may not be found. It is in our sole discretion whether we can legally ship you wine. We always recommend shipping to a business address where someone will be present to receive it during business hours. All shipping carriers require an adult signature at the time of delivery. Signature releases are not accepted. If the shipment is returned to us for an improper or incomplete address we will have to re-charge you for re-shipment, so please make sure the address is complete including business name, department or mail stop, if any, and suite number if going to a business complex. By submitting an order to Chateau Cellars you are stating that you are 21 years old or older, and warrant that you are legally able to purchase and consume alcoholic beverages at your place of delivery. We make no representation to the legal rights and ability of anyone to ship or import wines into any state outside of Florida or any country outside the USA. YOU, the buyer, are solely responsible for shipment of alcoholic beverage products. By placing an order for delivery in the USA, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.

DO YOU DELIVER INTERNATIONALLY?

We do not offer international shipping.

ARE THERE OTHER SHIPPING RESTRICTIONS?

By submitting an order you are stating that you are 21 years old or older, and warrant that you are legally able to purchase and consume alcoholic beverages at your place of delivery.

Title to and ownership of alcoholic beverages passes from the Company to you in Florida, the state in which the sale occurs, and you take all responsibility for the product being transported from Florida, the state of sale, to your selected destination. You may pick up the product at the Company’s location or make independent delivery arrangements. Florida sales tax will be applied in all cases except where a permit issued by the state of ultimate delivery authorizes the collection of sales tax in that jurisdiction. The Company makes no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. You warrant that you are solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to your chosen destination.

For orders going to states in which the Company is licensed or has a direct to consumer shipping permit, title to and ownership of the product passes from the Company to you in Florida, and sales and other applicable taxes will be applied based on the requirements of the destination state. By placing an order, you authorize the Company to act on your behalf as your agent in arranging for transportation of the product at your direction. Alternatively, you may pick up the product at the Company’s location or make independent shipping arrangements. For any product picked up at the Company’s location, Florida sales tax will be applied.

We make no representations about the legality of shipping alcoholic beverages. You are responsible for compliance with all laws regarding such shipments. By arranging for transportation of the alcoholic beverages, Chateau Cellars is providing a service to, and acting as your agent. By utilizing this service from Chateau Cellars you are representing that you are acting in compliance with your local and state laws regarding the purchase, transportation and delivery of alcoholic beverages. You further represent that you have obtained any required permission, paid any required fees, are working through properly licensed intermediaries where required, are legally entitled to take possession of the alcoholic beverages, are legally entitled to take quantities ordered and that you and the person accepting delivery of the alcoholic beverage products are at least 21 years of age.

WHAT HAPPENS IF MY ORDER IS DELAYED?

If delivery is delayed for any reason we will let you know as soon as possible and will advise you of a revised estimated date for delivery.

Buyer may pick up the product at seller’s location, or make independent delivery arrangements. Seller makes no representation as to the legal rights of anyone to deliver or import any alcoholic beverages or other goods into any state. Buyer warrants he or she is solely responsible for the transport of the purchased products and for determining the legality and the tax/duty consequences of bringing the products to the buyer’s chosen destination.

Legal Disclaimer Section B. For orders going to states in which Seller is licensed or has a direct to consumer shipping permit, title to and ownership of the product passes from Seller to Buyer in the state to which the product is shipped, and sales and other applicable taxes will be applied based on the requirements of the destination state. By placing an order, Buyer authorizes Seller to act on Buyer’s behalf in arranging for transportation of the product at Buyer’s direction. Alternatively, buyer may pick up the product at the Seller’s location, or make independent shipping arrangements. For any product picked up at the Seller’s location, sales tax will be applied based on that location. Prices of products do not include shipping/handling charges, the cost of which varies depending on destination, number of bottles ordered and choice of delivery options.

ALCOHOLIC BEVERAGES MAY BE SOLD AND DELIVERED ONLY TO PERSONS WHO ARE AT LEAST 21 YEARS OLD AND BY PLACING YOUR ORDER, YOU REPRESENT AND WARRANT TO US THAT YOU ARE AT LEAST 21 YEARS OLD AND THAT THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD AND CAN ACCEPT DELIVERY OF ALCOHOLIC BEVERAGES.

When your alcoholic beverages are delivered, the person receiving delivery will be required to show identification proving that he or she is at least 21 years old. If any person under 21 years of age fraudulently orders and has wine shipped to them, the wine will not be released to them, and will be returned to us, and the cost of return shipping will be charged to the responsible party.

BY ORDERING YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE SELLER FOR ANY RESULTING CONSEQUENCE OF A FRAUDULENT ORDER OR ANY MISREPRESENTATION AS TO THE AGE OR LEGAL ABILITY OF ANY INTENDED RECIPIENT TO RECEIVE SHIPMENT OF ALCOHOLIC BEVERAGES.

If you change your order after it is prepared for shipping, we reserve the right to charge for additional handling and packaging materials.

Parents or legal guardians will be held responsible for actions of their minor children. If necessary, legal action will be taken against any and all parties attempting “wire fraud.” The cost of shipping to, and returning to us of any wine in any such operation will be charged to that agency.
